There are a lot of items that go into a marriage-based adjustment of status application - also called a green card application. If you are handling the process yourself it can be very stressful to ensure that you are including all of the required items. We have created the instructions on this page based on the protocol we follow at our law firm when preparing adjustment applications for our own clients. We explain all of the forms involved, and list all of the supporting documents that go into a standard adjustment package.

I will apply after my wedding. I have been with my partner for two years and now we want to marry. My fiancé is American and I came to US legally with student visa 2 years ago, we share bank account, I have my driving license and social security because I had a different visa in the past and I have searching for information about this process and they also asked for show that we share bills together right ? Even though I have social security I can’t work because my previous visa doesn’t allow me to work or I can get in trouble and lose it. So my question is how should I show them that we share bills together when I can’t work ? He put me on his bank account one year ago and my ID and all documents from my school and insurance have the address from our home is that enough?

Hi Mr.Greg, that is a very helpful and informative video, thank you for your time and precise explanations! I have 3 questions that nobody askes so maybe there is someone else out there who will benefit from the answers like me! I would really appreciate if you could respond... 1-) I'm wondering if original documents are asked to be attached to the packets (like I-130 etc ) or they will only include the copies of the original papers that will be presented in the interview ? Does USCIS ask for an original document in packages sent to them except for passport style photographs or maybe proof of relationship photos... 2-) are certified copies only necessary for translated documents ? Do we need any copies that need to be certified among the ones mentioned in your video? 3-) police clearance and criminal records are different things so, if someone is clean on papers, do they still have to attach a paper to the packets if yes, which one is necessary and also which country's record is necessary like usa records or home country records ?

Thank you much for this Video! I have a question. I’m immigrant. My husband is American citizen and he had multiples arrests from the past but none under the Adam Walsh Act. We were told by an attorney that his records must be send along with the petition and they it might be denied even though I have no records at all. Is this true? Why do we have to send his records with the petition if I’m the one asking for a green card? Also, in one of the forms (I think the employment one) it asks if I ever worked without iNS authorization.... since my visa (J-1) is over expired and I have worked after that... what should I mark? Yes or no? Thank you so much!!

He actually never mentioned the Awa. It was me who started looking information since he said my husband would have to send all his records. I found that odd. I asked other attorneys and they said the same as you so I think we are good to go. I appreciate your quick responses a lot and even when I’m doing all the paperwork by myself I’ll consider hiring your firm in the future If I need an attorney. Thanks a lot again!

"Simple" DUI and drug possession offenses generally do not fall under the Adam Walsh Act, which relates primarily to offenses that are sexual in nature. Perhaps your attorney knows something about these matters that falls under the AWA. But normally a U.S. petitioner does not have to submit documents pertaining to DUIs or drug offenses. Hi there. The Adam Walsh Act is a rare exception where the U.S. petitioner's criminal background is relevant. If your spouse's criminal issues fall under the AWA then he will need to submit the required records and potentially request a waiver.

The supporting documents get attached to the legal forms and everything is filed together. Law firms double-punch the top of the pages and bind them. Photos can go in a plastic bag , attached by a rubber band (though it's best to print everything except passport-style photos on 8.5x11" paper). Good luck!

Jemaa - The only update from the time this video was made is that the Form I-130, Supp A is used instead of the G-325As mentioned in the video.

It's long-established policy with USCIS that you can bring the medical exam to the interview. That is a wise approach, since medical exams expire after 12 months, and it is very possible that adjustment interviews are going to be pushed out past one year. That means that if you file it with your initial packet you may end up doing two exams. So unless you enjoy getting poked and prodded...

Thanks, Idris. They must be filed with the initial packet, otherwise you will get a Request for Evidence. *However* you can also provide additional documents at the interview. This is very often a good idea, especially because interviews are taking over a year. So you will have 12 months (or so) of additional financial records, photos, etc.

It's "permission to accept employment" since you would be getting a new basis for employment authorization. Make sure you aren't subject to the 2-year foreign residency requirement before applying!

Thank you for the quick reply! That is what I suspected. Regarding the I-765, I am currently on a J-1 Research Scholar visa until beginning May 2018 and am about to file the application for the adjustment of status soon. Since the J-1 visa is also a document with permission to accept employment, would I have to opt for renewal in the first question, or just permission to accept employment?

Unreported income cannot be used to meet sponsorship requirements. Also, if a family has been incorrectly filing their IRS returns they need to get that fixed before completing the immigration process.

Mel ~ Section 245A of the Immigration and Nationality Act requires that someone have been lawfully inspected before seeking "adjustment of status" as described above. The primary exception is for those who had a prior immigration petition filed for them. If that doesn't apply, the individual will normally need to seek processing through a US consulate, and will normally require an I-601/I-601A waiver for their unlawful presence.

My wife has only been here since June and I neglected to put her on any bank account or billing accounts. Her I-94 says her visa term is up in January 2018. She is here on a tourist visa she obtained before we got married. Is there a way to extend her stay past January or should I just put her on a billing and bank account right away and submit the forms?

The primary issue to be concerned about in these situations is the issue of "immigrant intent." What if you and your US spouse initially met outside of the US and went out a couple of times, but didn't really establish a relationship until the non-US person came to the US on a B1/2 to visit and then decided to seriously date the US person and they married after 60 days. Would the fact that you knew one another prior to the alien's arrival jeopardize your application?

Excellent question. (They make wine in Manchester?). It depends on the foreign national's intent at the time of seeking entry. You are not permitted to enter on a B-1/2 with the preformed intention to seek residency. It doesn't formally bind USCIS on I-485 adjustment applications, but USCIS may be adopting it. Such a person may or may not even be able to apply. They may not be able to adjust status (Section 245(A)) if they entered illegally. And departing the U.S. for a visa application may lead to inadmissibility for 3 or 10 years, or potentially forever. You really need to talk to an attorney to figure out if he has an option.

We know this isn't what people want to hear, but you need to talk to an attorney. Even if you plan to do the paperwork yourself. But get a consultation so a good lawyer can give you an assessment of whether you're eligible to proceed. That's a potentially complicated situation. The fact that she has TPS does not guarantee that she is adjustment-eligible. For starters, standard "245(A)" adjustment requires that she have had a lawfully inspected entry.

Hi, i have few questions concerning the i-864 form, my spouse (petitioner) worked for the last three years but only filed taxes for one year (2016) what should we do in this case? i also have a co-sponsor that has three years of taxes. should we send out two i864 forms,one for the petitioner and one for the co-sponsor? for form i130: Under part 4 where it asks about the beneciary's passport number do i put the expired one that i entered the US with or the current passport? Hi Greg! I just started working for IBM in february and before that I used to have small campus jobs. I do not have w2 tax form stating that I can support my husband although now that I have a good full time job post college, I have a good salary. Hi, Sarah - congrats on the job! Co-sponsors (also called joint sponsors) are different from household members. The former use a Form I-864; the latter use an I-864A. You'll need to review the I-864A instructions to assess whether your aunt qualifies as a household member, or if she should sign a co-sponsor I-864. Good luck!

The current passport is required. But the visa stamp will help you show lawful inspection. Spring for the extra 15 cents and include both :-)

Makulay: There is no way to force a US citizen to initiate the immigration process by filing a Form I-130. But in situations that involve abuse from a US citizen spouse it is sometimes possible for the foreign spouse to "self-petition" under the Violence Against Women Act using a Form I-360.

Hi, My fiance is American Citizen, I was on an F1B-student visa then switched to H1B visa through my employer. A Little bit about us: My fiance has two teenage kids, she was never married though, I am single as well. We live in two different states, we got engaged in Feb 2016, we are getting married this September, I would like to adjust my status as soon as possible, primarily to get employment authorization so I can switch job to move closer to my fiance so we can live together sooner, i.e, before we get married. Hi Greg, I am filing for AOS from a K1 visa using forms I-130, I-130A, I- 485, G-1145, G-325A ( x2), I-131, I-765, and I-864. My question is in filling out my wife's name on all these forms, do I use her maiden name or my last name? We have not gone to get her SSC yet but will before we send in the AOS packet, and are going to get her card using my last name, if we can get her a SSC before the AOS petition, can we? First of all, an I-130 isn't required in a K-1 adjustment (assuming you married and filed in the 90-day window). Primary names on all USCIS forms should always be current legal names. If she's adopted your surname, that name is used.

The child may also be able to adjust, though the procedures for doing so depend on whether the petitioner is a US citizen or permanent resident.

WHAT IF THE APPLICANT HAS A VALID VISA AND HE OR SHE IS NOT IN LEAVING IN THE US. DOES SHE OR HE STILL NEED TO FILE THE I 130? BECAUSE MY FIANCE IS IN HAITI WITH A TOURIST VISA. DOES THAT MEAN SHE NEEDS TO COME STAY IN THE US.

Hi, Michael: That's very common for our clients. We just leave that question blank. It's still a good idea to file the I-131 as there's no additional fee and you never know if plans might change.

My wife is an American citizen, and she is submitting the I-130 petition.I'm the beneficiary and am a foreigner living in europe. In this video you make it sound like I need to submit a I-485, but I have not come across this form at all before? Can you clarify what it is, or am I misunderstanding something?

Hi, Bertel: The I-485 is for folks applying for residency within the United States. It has no application to consular processing, which is what you are pursuing.

Hi Greg, Thank you for this helpful video. If different forms (I-485, I-130, etc.) ask for the same supplemental documents do I have to submit duplicates of those documents for each form, or can I include just 1 copy of each supporting document for the entire package? Thank you.

Good question, Jordan. For things like a photocopy of your passport, it's fine to submit only one. But you have to submit passport-style photos for each form.

also if my wife and step child already did the required medical examination back in their home country are they supposed to do it again now before i file the joint i485 and i130 forms and is there an expiration date on those medical exams because it's been 2 years since they've been in the US already. i wasn't able to make the required amount at the time according to the 2015 poverty guidelines.

Hi, Vic: The financial sponsorship requirement is based on the U.S. Federal Poverty Guidelines, so not really anything to do with how much a person made in another country. In some situations it is possible for a U.S. citizen to petition for a foreign stepchild, but as is often the case, details matter.

Hi, Nag: J-1s need to be careful about the foreign residency requirement - if subject to the 2-year residency requirement you have to live abroad for 2 years or apply for a very difficult waiver. Before getting started, you would be well-advised to talk to a lawyer so that you can ensure that you are actually eligible to adjust status. Getting all the forms right doesn't help if you aren't eligible in the first place.

I am on F-1 student visa and I came to the U.S. in January 2016. I stayed in school and in September 2016 I met my now wife. We dated for 3 months then got engaged in November. We then got married December 17th. We live together and she has a son from another relationship (not marriage). This is our first marriage. I applied for AOS in April 2017. Do you think there is a red flag or a problem here? We have joint bank accounts, pics, letter from friends and family and Religious Leader, joint tax returns, letter from landlord, not.etc. Please let me know. Is there any red flags? Is my case strong enough?

To give you a sense, there are over 60 grounds of inadmissibility, plus additional eligibility rules under INA 245A for adjustment. So this is like texting a doctor and asking - "I feel fine, does that mean I have a clean bill of health?" Well, the doctor can't offer a meaningful answer without doing a checkup. Likewise, an attorney can't offer a meaningful advice without talking to his/her client.

that was very helpful! one question, If my spouse entered the country legally with a passport and visa, but that passport expired and he got a renewal passport at the consulate, which passport number should we use when filling the forms for the adjustment of status packet? (of course, we are attaching photocopies of both passports, but we are not sure if we should fill out the forms with the passport number he had when entered the ocuntry(expired now) or the new passport?

Hello, I am not. That is stated on my j-1 visa : 'Bearer is not subject to section 212(E). Two year rule does not apply.'

Joana ~ You should consult an attorney to ensure that you are not subject to a two-year foreign residency requirement on the J-1. If so, you will require a waiver to proceed.

Hi, Assel: NO, the birth certificate isn't needed. Instead, you need: • U.S. Passport • Naturalization certificate or certificate of citizenship, or • Form FS-240, Report of Birth Abroad.

Hi, there. The financial sponsorship requirement is unfortunately very strict. If the sponsor's income and/or assets are insufficient, then a joint sponsor will be required. The income of the foreign national can also be used, but only if based on lawful U.S. income that will be continuing.
